Terms and Conditions of Service
1. Quotations and Validity:
a. Validity: All quotations are valid for 7 days from the date of issue.
b. Revised Quotes: Each new quotation issued (e.g., Version 2, 3, etc.) entirely supersedes and replaces any previous versions.
c. Price Fluctuations: Prices for materials are subject to supplier increases. The plumber reserves the right to adjust the quoted price and final invoice to reflect supplier cost changes between the date of the quote and the commencement of work. To lock in pricing, the deposit must be paid immediately.
2. Scope of Work:
a. Services are strictly limited to the description in the accepted quotation. Any additional work requested will be treated as a "Variation Order" and billed accordingly.
3. Pricing and Payment Terms:
a. Deposit: A 70% deposit is required before work commences. This deposit is non-refundable once materials have been purchased or custom-ordered.
b. Final Payment: The remaining balance is due immediately upon completion of the work.
c. Late Payments: Late payments will incur interest at a rate of 2% per month or the maximum rate permitted by law, calculated monthly on all overdue amounts.
d. Ownership: All materials supplied remain the property of the plumber until the invoice is paid in full.
4. Access and Utilities:
a. The client must provide clear, safe, and unrestricted access to the work site, including the use of water and electricity at no cost to the plumber. Any delays caused by restricted access may result in additional labor charges.
5. Permits and Compliance:
a. Unless otherwise agreed in writing, the client is responsible for obtaining any necessary permits or body-corporate approvals.
b. Certificates of Compliance (COC): Where required, a COC will be issued only once the final invoice is paid in full.
6. Force Majeure:
a. Neither party is liable for delays caused by events beyond their control, including but not limited to: Acts of God, civil unrest, strikes, or utility failures (e.g., load shedding or municipal water outages).
7. POPI Act Compliance:
a. The client consents to the plumber processing their personal information (name, address, contact details) for quoting, invoicing, and service delivery in accordance with the Protection of Personal Information Act (POPIA).
8. Guarantee
a. Labor: Guaranteed for 1 year from completion.
b. Materials: Subject to the Manufacturer’s Warranty.
c. Exclusions: The guarantee is void if the installation is tampered with by third parties or subjected to misuse.
9. Cancellation:
a. Cancellations require 3 days' notice. Cancellations with less notice incur a Cancellation Fee of R450.
b. Non-Refundable Costs: This cancellation fee is separate from, and does not override, the non-refundable deposit where materials have already been purchased.
10. Liability and Finishes:
a. The plumber is not liable for pre-existing structural issues or hidden defects.
b. Finishes: The plumber is not responsible for matching existing tiles, finishes, or surfaces unless explicitly stated in the quotation.
11. Completion and Deemed Acceptance:
a. Upon completion, the work will be inspected by the client.
b. Deemed Acceptance: If the client fails to raise written defects within 48 hours of completion, the work will be deemed accepted and the final payment will become due immediately.
